One of the first questions asked during the initial interview to pre-qualify for most life insurance policies is “Do you participate in hazardous activities such as ski diving, scuba diving, mountain climbing, etc.?” I recently read an article concerning the family of a man who had died “heli-skiing.” The family was denied recovery on the life insurance policy. The reason? When he applied for the policy, he was asked about “hazardous activities” and he failed to mention that he occasionally engaged in a sport where you get taken by helicopter to the top of a mountain, wear an oxygen tank, and try to ski to the bottom.
The court said that, “a reasonable ordinary person would understand that a sport whose participant equip themselves with ‘avalanche beacons’ and ‘avalungs’ and then ride in helicopters to the summits of isolated back-country mountains in order to ski down ungroomed alpine terrain falls along with sky diving, hang gliding, and scuba diving into the common sense category of ‘hazardous’ activities.”
